China Attestation

Time is our strength

The Chinese market demands productivity and haste. Yet, with a growing demand to legalize documents for use in China, regulatory controls are reaching new heights. This leaves little room for error, and even less for inefficiency and inflexibility. Not only are regulatory changes a norm, different provinces have different legalization regulations and are subject to change from time to time. Decades of experience has allowed us to adapt quickly to those changes, ensuring that your documents are properly legalized.

The Basics of China Attestation

We are here to help you understand the context and lead you through the process

What is China Attestation and its purpose?

China attestation is a process to legalize a document from Hong Kong for use in China by a China-Appointed Attesting Officer (中國委託公證人). It authenticates either the signing of a document and/or that a copy of a document is a true copy. It allows end-users in China to be certain that the document was duly signed and/or that the document is legitimate.

Who are China Attestation Officers?

China-Appointed Attesting Officers are qualified Hong Kong lawyers who have been appointed by the Ministry of Justice of the People's Republic of China after passing the prescribed qualifying examinations. To access registered China-Appointed Attesting Officers in Hong Kong, please click here

When might you need China Attestation?

You would often be told by the Chinese entity or party that certain documents would have to be attested before they can be used in China. However, it would be useful to know that generally, any acts or documents that has legal significance which originates from Hong Kong, to be used in China, should be attested so that the receiving party can rely on them.

What are the processes involved?

This is often a twofold process. The first step involves a China-Appointed Attesting Officer (中國委託公證人) verifying the signature of the person referred to in the document. This is to ensure that the person signing the document is doing so through their own free will, and that no one can pretend to be someone else. The second step is to seal the signed document and transmit it to China Legal Services (H.K.) Ltd. for verification, so that it can be relied upon in China.

Who can change legalization regulations and how often do they change?

Whilst the Chinese governmental structure is centralised, there are many layers of authorities in China who can introduce amendments to regulations. Further, different provinces in China may have different administrative rules. Given the pace at which those rules move, we confirm the requirements of the receiving authority before every filing rather than relying on precedent.
