Notarization

Time is our strength

Our vision is to give our clients as much global accessibility as possible. Over the years we have built a far-reaching network of overseas partners giving your documents access to all major and minor jurisdictions. Our vast experience with multi-jurisdictional clients makes us an expert in notarial compliance.

We have worked with numerous banks and corporations who faced difficulties with notarial compliance and a tight time-budget - this is particularly true when the relevant documents are to be used in a country that is not part of the Hague Apostille Convention. It is with this in mind that we have a legalization team specialized for international compliance, who aims to find a solution for our clients in a cost and time efficient manner.

The Basics of Notarization

We are here to help you understand the context and lead you through the process

What is Notarization and its purpose?

Notarization is a process to legalize a document by a Notary Public, no matter where the document originates from, to be recognized and used internationally. It authenticates either the signing of a document and/or that a copy of a document is a true copy. It allows end-users in the receiving country to be certain that the document was duly signed and/or the document is legitimate.

Who are Notary Publics?

Generally, Notary Publics can be seen as an officer of the law who can, inter alia, draft, attest and certify documents under their official seal and signature. In Hong Kong, only lawyers have the capacity to become Notary Publics and must pass the Notary Public Examination organized by the Hong Kong Society of Notaries.

When might you need the services of a Notary Public?

An overseas party may, for any acts or documents that has legal significance, request that the relevant documents be notarized. This is to ensure the authenticity of the documents.

What are the processes involved?

The process of notarisation is generally twofold. The first step involves a Notary Public verifying the signature of the person referred to in the document. The second step is to authenticate the signed documents so they can be relied upon by the receiving party.

Notarization under the Hague Apostille Convention

The Hague Apostille Convention simplifies legalization or authentication procedures between member states. Where the document originates from Hong Kong for use in another member state, a notarized and apostilled document can generally be accepted across other member states.

Notarization outside the Hague Apostille Convention

Documents outside the Hague Apostille Convention usually require more involved authentication procedures. The route depends on where the documents are to be used and the requirements imposed by the relevant authority.
